Limited Warranty

What Aquastra warrants, for how long, what is excluded, and how a claim is made.

1What this warranty covers

1.1Aquastra warrants that, at handover, the platform is free from defects in materials and workmanship attributable to Aquastra, subject to the periods and exclusions below.

1.2Cover runs from the handover date recorded in the handover certificate.

3What this warranty does not cover

3.1Normal wear, weathering, UV fade, staining, corrosion of consumable fittings, and gradual deterioration consistent with the marine environment.

3.2Marine growth, fouling and antifouling performance.

3.3Damage from grounding, collision, impact, sinking, fire, storm, or any event insurable under a marine policy.

3.4Damage from mooring, berthing or towing not performed to Aquastra’s written guidance, including relocation of the platform.

3.5Damage from operation outside the platform’s published survey range or its stated siting class (Coastal or Open-Water).

3.6Damage from loading beyond the specified capacity, including deck loading and occupancy.

3.7Failure to carry out the scheduled maintenance in the handover documentation, or maintenance performed by an unapproved party.

3.8Alterations, additions or repairs made by anyone other than Aquastra or an Aquastra-approved contractor.

3.9Any defect in a design, material or supplier specified by the Buyer against Aquastra’s written advice.

3.10Shore-side infrastructure — moorings, gangways, pontoons, shore power, water and waste connections — unless supplied by Aquastra.

3.11Consequential loss, including loss of use, loss of charter or berth income, accommodation and travel costs.

3.12The regulatory or permitting status of the platform at its deployment site. Whether a platform is regulated as a vessel or a structure varies by deployment and jurisdiction, and permits are the Buyer’s responsibility under the Terms of Sale.

4Conditions

4.1The platform must be maintained in accordance with the handover documentation, and records must be retained and produced on a claim.

4.2The Buyer must notify Aquastra in writing within thirty (30) days of becoming aware of a defect, and must not carry out repairs before Aquastra has had a reasonable opportunity to inspect — except where immediate action is needed to prevent injury or further damage.

4.3Aquastra or its representative must be given reasonable access to inspect the platform.

4.4The platform must have been paid for in full.

5What Aquastra will do

5.1Where a valid claim is made, Aquastra will, at its option, repair the defect, replace the affected part, or refund the portion of the price attributable to it.

5.2Repair or replacement is the Buyer’s sole and exclusive remedy under this warranty.

5.3Aquastra bears the cost of the remedy itself — parts and labour — in every valid claim, wherever the platform is. Access costs are shared by zone, measured from the Seller’s Dubai facility:

In every zone, if the platform can be made accessible afloat at its berth, the Buyer must allow that in preference to haul-out.

6Transfer

6.1This warranty is transferable once, to the first subsequent owner, for the unexpired balance of each applicable period, subject to: written notice to Aquastra within 30 days of the transfer; a complete maintenance record; a satisfactory Aquastra inspection at the transferring owner’s cost; and payment of Aquastra’s transfer administration fee.

7Relationship to statutory rights and to the Terms of Sale

7.1This warranty is in addition to, and does not affect, any rights the Buyer has under applicable UAE consumer or commercial law.

7.2This warranty is subject to the limitations and exclusions of liability in the Aquastra Terms of Sale.

7.3Governing law and dispute forum follow the Terms of Sale.
